-president obama. james holmes is due back in court today. prosecutors are expected to read the more than 100 charges against the former doctoral stunt. holmes is accused of killing 12 people and injuring 258 others and boobie trapping his apartment with explosives. >> reporter: james holmes could face first-degree murder charges for each of the 12 people who were killed inside the theater. but a former prosecutor says holmes probably won't face an additional homicide charge after one of the wounded victims suffered a miscarriage. the family of ashley moser says she lost her unborn child over the weekend. another lost to the family after moser's 6-year-old daughter, veronica, was killed in the attack. >> she came to one time and screamed, "where's my baby?" i loved her for two years. i helped raise veronica for two years. and now they're gone. >> reporter: when holmes appeared in court last week, he appeared drowsy fuelling speculation that defense may try to plead insanity. >> this is a classic case where it's going to be his mental state during the process and his mental state at the time t

in the case. police here in aurora say that they've removed all hazards from james holmes' apartment, and some of the evacuated neighbors were actually allowed to return last night. but not before police carefully detonated some explosives. one neighbor said she nearly entered the apartment early friday morning when loud techno music started blaring. she tried yelling it holmes and noticed the door was unlocked but didn't open it. that may have saved kristin fonzie's life. she now knows the music was set to play while the suspected gunman was at the theater. police say had she entered the apartment she likely would have died. jim spellman is at the apartment complex where holmes lives this morning. you have new information on the investigation. i understand they questioned somebody else. >> reporter: that's right. overnight, multiple reports surfaced that there may be a potential second suspect in this case. aurora police wanted to knock that down pretty quick. they put out a statement saying, yes, they interviewed somebody they described as an associate of james holmes, the accused shooter in

james holmes' apartment and we can take a look at that now. i should explain that it was taken from the outside looking inside. however, our crew did not actually go into the residence which is still not accessible. you could see a soldier of misfortune poster in his bedroom and other items. aurora police investigators have already removed countless pieces of evidence to be used in the case against james holmes and the apartment building where he lives remains evacuated and surrounding with police barricades although some folks have been allowed to briefly return to gather some personal belongings. of course, we all got our first look at 24-year-old james holmes yesterday as he made his first appearance before a judge in arapahoe county. he was advised of his rights and told there would be no bond. he sat away from the people in the courtroom including most of his defense team. he didn't say a word the entire time. next up for the man suspected of killing 12 people and injuring dozens more, the filing of formal charges is scheduled to ham on monday, july 30th. district attorney not

. james holmes is expected to be formally charged in the case. 12 people died, 58 others were injured. dave mattingly joins us live outside the courthouse. dave, what are we expecting tomorrow? >> reporter: well, tomorrow the prosecution is going to set the tone with how this case is going to be heading through the courts here in colorado. what we're expecting to hear with 12 people killed, that's 12 potential premeditated murder charges we could hear tomorrow. 58 wounded in that theater could mean dozens of potential attempted murder charges. we're also going to be watching closely to see if there's any sort of decision made about the mysterious package the alleged killer sent to his psychiatrist at the university of colorado. that package now in the possession of authorities. the defense says that could contain privileged communication between a patient and his doctor and may not be released into evidence. we're going to see if the judge is going to rule on this if he allows the contents of that package into evidence, and if so, how. >> and, david, police say holmes had rigged his a

in the university of colorado mail room that appears to have been mailed by the suspected shooter, james holmes. cnn's ed lavandera is in aurora for us. ed, what do we know about this package? >> reporter: well, we're still trying to gather information on what exactly is inside that package, wolf. but as you mentioned that law enforcement official telling cnn that on monday police and fbi discovered a package that was apparent apparently sent by james holmes, the 24-year-old suspected gunman. now it's unclear obviously if this package was indeed sent by him, it was clearly sent before he was taken into custody. it arrived at some point on monday at the university mail room. we've also been told by hospital officials over the last couple of days this is something we've been monitoring for some time that there were two packages that were suspicious and were being looked into, one found in the mail room and also one that was actually delivered to a university professor. so we've been trying to nail down more information on this. and we'll continue to do so, wolf. >> what's the university of colorado sa
